Terms and Conditions

 

  1. Information on how to enter and prizes form part of the Terms and Conditions of Entry. Entry into this competition is deemed acceptance of these Terms and Conditions.
  2. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.
  3. The prize consists of legal services to the value of $5,000 Inc GST to be provided by Legal Practice Holdings (“LPH”) provided those service fall within the scope of services provided by LPH in the absolute discretion of the Legal Practitioner Director of LPH.
  4. The prize shall be available for redemption for 12 months from the date of the draw (being until 25 January 2022).
  5. Unless otherwise stated in these terms and conditions, no person may enter this Promotion more than once and persons may not enter or participate in it on behalf of any third party.
  6. Entries must include all requested contact details, including a valid email address, to be eligible to win. Entrants may only enter in their own name. Inaudible, incomprehensible, illegible, and incomplete entries may be deemed invalid.
  7. Should an entrant’s contact details change during the Promotion Period, it is the entrant’s responsibility to notify LPH. A request to access or modify and information provided in an entry should be directed to LPH.
  8. LPH reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of entry or who has, in the opinion of LPH, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or LPH. This includes, but not limited, to entrants using multiple email addresses.
  9. Entry is open to those who complete in full and return the “MyCRA Lawyers How are we doing? Quiz” ( “the quiz”) and who is a resident of Queensland.
  10. A successful entrant (prize winner) can transfer the prize to an Immediate Family Member. Immediate Family Member means and is limited to the following: spouse, ex-spouse, child or step-child, parent, step-parent, brother or sister (whether natural or by adoption or marriage).
  11. The Promotion will be conducted during the Promotion period ending midnight AEST 24 January 2021.
  12. The winner will be notified by phone and or email within 24 hours of the draw to be undertaken on 25 January 2021.
  13. The prize will be awarded to the person named in the entry.
  14. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and LPH’s requirements. It is the responsibility of the winner to confirm such conditions with LPH or other relevant third parties.
  15. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by LPH in its absolute discretion.
  16. To the greatest extent permitted by law, LPH excludes all warranties, representations or guarantees (Warranties) regarding the Promotion and any prizes, including any Warranties which may have been made in the course of advertising or promoting the Promotion. The conduct of the Promotion or the supply of prizes may involve third parties, and LPH makes no Warranties and disclaims all liability in connection with any such third parties, their acts or omissions. By entering the Promotion, an entrant releases and indemnifies LPH and its related bodies corporate (including the officers, employees and agents of each) from and against all actions, penalties, liabilities, claims or demands the entrant may have against LPH or that LPH  may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an entrant entering or participating in the Promotion or winning or failing to win a prize, or using or permitting any other person to use the prize, except for any liability which cannot be excluded by law or which would cause any part of this clause to be void or unenforceable.
  17. If despite the foregoing clause, LPH incurs a liability to an entrant under any law which implies a Warranty into these Terms of entry which cannot legally be excluded, LPH ’s liability in respect of the Promotion is limited, in LPH ’s discretion, to either resupplying such goods or services as form part of the Promotion, or paying the cost of resupplying those goods or services.
  18. Without limiting any of the foregoing, in no circumstances will an entrant or LPH have any liability to the other for any loss or damage suffered which is indirect or consequential in nature, including without limitation any loss of profit, loss of reputation, loss of goodwill, or loss of business opportunity.
  19. LPH and its associated agencies and companies will not be liable for any delay, damage, or loss in transit of prizes.
  20. LPH and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
  21. In the case of the intervention of any outside act, agent, or event, which prevents or significantly hinders LPH ’s ability (or that of a third party involved with the Promotion) to proceed with the Promotion on the dates and in the manner described in these Terms of entry, including but not limited to vandalism, natural disasters, Pandemic, acts of God, civil unrest, strike, war, act of terrorism, then LPH ’s obligations in respect of the Promotion will be suspended for the duration of the event and, in addition, LPH may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions, subject to approval of the relevant authorities.
  22. If the prize is unavailable, for whatever reason, LPH reserves the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
  23. LPH reserves the right to redraw the prize if an entrant who claims to be a prize winner is unable to satisfy these terms and conditions.
  24. In consideration for LPH awarding the prize to the winner, the winner hereby permits the winner’s submission, image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with LPH or the advertising or marketing thereof, in any media whatsoever throughout Australia and the winner will not be entitled to any fee for such use.
  1. LPH does not warrant the merchantability, suitability and/or fitness for purpose of any goods and/or service awarded as a prize.
  2. No other costs will be included and all expenses will be at each winner’s cost.
  3. All prizes are: subject to availability, non-transferable and non-exchangeable (except for as specified in point 10 of these terms and conditions), must be used on any dates specified in these terms and conditions or by LPH, and are not redeemable for cash.
  4. If a prize winner does not take any element of a prize at the time stipulated by LPH then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that prize or any part of it.
  5. LPH reserves the right to exclude any persons from the Promotion on the ground of their medical condition or history, for the safety of LPH ’s staff members or others or for any other reason, for example bringing LPH’s brand into disrepute. LPH also reserves the right to disqualify contestants if:
    • a contestant at any stage engages in, causes or incites physical violence, inappropriate, illegal, unsocial or unsafe behaviour; and/or
    • the safety of any of LPH ’s staff members is compromised.
  6. LPH will not award the prize if the Promotion is terminated for whatever reason.
  7. The winner will be notified by phone and/or email within 24 hours of the draw.
  8. The prize will be awarded to the person named in the entry.
  9. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
  10. Any tax payable as a result of a prize being awarded or received will be the responsibility of the winner. Winners should seek independent financial advice prior to accepting a prize if this is a concern.
  11. By entering this Promotion all entrants:
    • Assign to LPH all rights including present and future copyright in their entry (including any Submission) and publicity material in all media (including, without limitation, the internet) and whether in existence of or created in the future;
    • consent to any use of their entry which may otherwise infringe their moral rights and agree not to assert any moral rights in respect of their entry, (including any Submission) and the publicity materials (wherever and whenever such rights are recognised) against LPH, its assigns, licensees and successors in title; and
    • Undertake to LPH that their entry (including any Submission) is not in breach of any third-party intellectual property rights.
  12. All decisions and actions of LPH relating to the Promotion and/or redemption of the prizes are excised accordingly at its absolute discretion are final. No discussions or correspondence with entrants or any other person will be entered into.
  13. A failure by LPH to enforce any one of these terms and conditions in any instance(s) will not give rise to any claim or right of action by any other person or contestant.
  14. This Promotion is governed by the laws of Queensland. Entrants submit to the jurisdiction of the courts of that State.

Privacy Collection statement

  1. By submitting an entry into this competition entrants consent to receive promotional and other marketing messages from LPH (including messages sent electronically for an unlimited period of time). Entrants will be able to opt-out at any time by following the instructions included in each message sent by LPH.

LPH and its related entities collect entrants’ personal information for the purpose of 1. conducting and promoting this competition (including but not limited to determining and notifying winners), 2.  Marketing LPH’s range of products and services to the entrant. LPH may disclose personal information collected to an agent who is engaged to conduct the competition draw and for prize fulfilment. LPH may also disclose personal information collected to Australian regulatory authorities, such as the regulators of trade promotions.
